What Information We Collect
Personal Information we may collect from you includes:
- your name and email address
- your credit card information (although we use a third party payment processor), billing address and shipping address
- live chats and customer services phone calls
We may also collect some of the following Non-Personal Information from you:
- the IP address of the computer you use to access our Services, potentially including location data based off of that IP address
- the type of browser software you are using
- the date and time you access our Services
- the website address, if any, that linked you to our Site
- search engine search terms and advertising clicks/actions
- other non-personally identifiable traffic data
- products you purchase from us
- responses to any online surveys run by Chubbies, either on our website or via our email list
Cookies and Pixel Tags
Like many websites, we use "cookies" to collect information. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. We use session ID cookies to enable certain features of the Site and App, to better understand how you interact with the Site and App and to monitor aggregate usage by Chubbies Users and web traffic routing on the Site and App. Unlike persistent cookies, session cookies are deleted from your computer when you log off from the Site, App and Service and then close your browser. You can instruct your browser, by changing its options, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. If you do not accept cookies, however, you may not be able to use all portions of the Site, App or all functionality of the Service.
Identity theft and the practice currently known as "phishing" are of great concern to Chubbies and e-commerce companies generally. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, your login information, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. How do we use this data?
Providing Services, Products and Information to our Customers including:
- account information management
- customer service responses
- access to specific features, gifts, products, and rewards
- contact to get feedback on your experiences with the brand, our services and our products
Administrative functions, including:
- measuring and predicting interest in our current, or potential, products and services and/or developing new products and services for our customers, as well as managing quality of our product and service offerings
- identity verification
- order and account-level communications including email and push notifications
- payment and transaction processing
- detect and prevent illegal or fraudulent activities
- enforce our terms of service

Ongoing research and development:

We also may contract to other third parties to provide us more information on our customer base, to serve the purposes of better targeting, customizing, and analyzing our marketing and our products/services
- we also may contract to partners who help us run and manage customer Surveys to gather information on our products, services, and marketing. All surveys are voluntary, and the information we gather in these surveys will serve to enhance our marketing, products, and services in the future. By participating in our surveys, you are agreeing to this use of the survey data in a non-personally-identifiable manner
Information Sharing and Disclosure
Chubbies offers a publicly accessible blog at blog.chubbiesshorts.ga (the "Blog"). Please note that any information you provide on the Blog, including, but not limited to, comments, may be read, collected and used by others who access the Blog. Also, if you choose to comment on any Blog post, the content of such comment, along with your name, email address and website URL will be publicly viewable via the Blog.
Third Party Services
Chubbies appreciates that our users are active in many different communities, both offline and online, and we like facilitating that wherever we can. Some parts of our Services can be linked up with other accounts you have, such as your Facebook, Pinterest, or Twitter. If you link to Third Party Services from our Services, we may collect some information about your use of the Third Party Service. We will only be able to collect the information if you've authorized the Third Party Service to provide us with that information or if you've made the information public. Additionally, if you mention us through your Third Party Services, we may collect information and content related to your comment that is publicly available. If you wish to limit the information available to us, you should be sure to manage the privacy settings of your Third Party Services. One thing we won't ever store is your Third Party Service password.
Aggregated Information and Non-Identifying Information
We may share aggregated information that does not include Personal Information and we may otherwise disclose Non-Identifying Information and Log Data with third parties for industry analysis, demographic profiling, and to deliver targeted advertising about other products and services. Any aggregated information shared in these contexts will not contain your Personal Information.
We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Site-related services (e.g., without limitation, maintenance services, database management, payment processors, web analytics and improvement of the Site's features) or to assist us in analyzing how our Site and Service are used. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
Compliance with Laws and Law Enforcement
Chubbies cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Chubbies or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.
Chubbies may sell, transfer or otherwise share some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.
Chubbies is very concerned with safeguarding your information, but no method of transmission over the Internet, or method of electronic storage, is 100% secure. When you enter sensitive information (such as credit card number) on our order forms, we encrypt that information using secure socket layer technology (SSL).
We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored "personal data" (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
Our Policy Towards Children
We do not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at firstname.lastname@example.org with "Privacy" as the subject line of the email. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.
How to Opt Out
We want to make sure that you are comfortable with the way we are collection, processing, and using your data, so we want to make sure we give you clarity of the various ways you can restrict our access to that data. Please note, however, that by opting out of any of these methods, you may be limited in your ability to access certain services, rewards, gifts and offers based on your exclusion. You may revoke Chubbies' right to process your Personal Information or Sensitive Personal Information by contacting us at email@example.com. If you opt out of our collection of Personal Information, we still retain the right to collect non-Personally Identifiable information in order to better our products, services, and marketing.
If you do not want to be on our list, you can unsubscribe at the bottom of every email. If you are still not unsubscribed, that is an error, and please email us at firstname.lastname@example.org. Note that you will continue to receive transaction-related emails regarding products or services you have requested, and other service-related, non-promotional emails.
If you have our Mobile Application and have opted into receiving push notifications, you can still opt out by going into the Settings section of your mobile device and disabling Notifications from the Chubbies application. If you have any troubles doing this, please email us at email@example.com
“Do Not Track”
Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
Cookies and Interest-Based Advertising
You may stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser preferences. Please note that cookie-based opt-outs will not affect data use on our mobile application.
The online advertising industry also provides websites from which you may opt out of receiving targeted ads from our data partners and our other advertising partners that participate in self-regulatory programs. Rights of Access, Rectification, Erasure, and Restriction
Note: there may be circumstances in which Chubbies is unable to provide access, including but not limited to: where the information contains legal privilege, would compromise others’ privacy or other legitimate rights, where the burden or expense of providing access would be disproportionate to the risks to the Individual’s privacy in the case in question or where it is commercially proprietary. If Chubbies determines that access should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries. To protect your privacy, Chubbies will take commercially reasonable steps to verify your identity before granting access to or making any changes to your Personal Information.
Security of Your Information
We take reasonable administrative, physical and electronic measures designed to protect the information that we collect from or about you (including your PII) from unauthorized access, use, or disclosure. When you enter sensitive information on our forms, we encrypt this data using SSL or other technologies. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.
If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your information to the United States and to Processing of your data globally. By providing your Personal Information, you consent to any transfer and Processing in accordance with this Policy.
Chubbies' services are not intended for children under 16 years of age, we do not knowingly collect Personally Identifiable Information from children under 16 years of age. Any users under the age of 18 must have their parent’s permission to access the Services. If you learn that your child has provided us with Personal Information without your consent, you may alert us at firstname.lastname@example.org. If we learn that we have collected any Personal Information from children under 16, we will promptly take steps to delete such information and terminate the child’s Account.
